Who processes personal data
- Your personal data is processed by Wine's Bay s.r.o., IČO: 095 45 743, with registered office at Zenklova 24/54, Libeň, 180 00 Prague 8, registered in the commercial register maintained by the Municipal Court in Prague under sp. stamp C 337906 (“ we ”), which is also the administrator of your personal data.
- These principles are in accordance with Regulation of the European Parliament and the Council (EU) no. 2016/679 on the General Data Protection Regulation (GDPR) and you will find information on what personal data we process, why and how we work with it and how long we will keep it. This applies to both our customers and users of the website www.winesbay.com (hereinafter referred to as the " website ").
1. Some of your personal data are necessary to properly fulfill the contract and order our goods. This is your data:
- first and last name;
- residential address;
- phone number and email;
- possibly information regarding the payment card - its number and date of validity (but we do not store this information);
- information regarding your visit to the website (IP address, device type, cookies, connection length, etc.);
- your user account credentials.
2. We also process your personal data to the extent of the goods you ordered from us, our mutual communication and other details regarding the contract concluded between us.
3. We use cookies for the website to function. All information about cookies can be found below in the section of this policy.
4. If you have become our customer, we can send you newsletters for a period of 3 years, unless you opt-out by clicking directly in the newsletter or sending an e-mail to info@winesbay.com. Our legitimate interest allows us to do so.
On what basis is the processing of personal data based?
We process your personal data for several reasons. Each of these reasons must also be supported by a legal basis for processing. In our case, these are:
For this reason, we process personal data in order to be able to deliver the goods you have purchased from us and to be able to contact you and communicate with you regarding the order and the contract.
We also process your personal data because our legitimate interest allows us to do so. This allows us to tailor the offer to you to suit your needs or to take appropriate action in the exercise or defense of our legal claims.
We also process your personal data because the law requires us to do so. For example, according to the Accounting Act, we are obliged to keep tax documents - invoices, which may contain your personal data.
You have the right to revoke your consent at any time by sending an email to info@winesbay.com . However, we are not obliged to delete all your personal data even after the period for which you agreed to the processing of your personal data or in case of withdrawal of consent. We may retain those where our legitimate interest allows or the law requires. If you withdraw your consent, this does not affect the lawfulness of the processing of personal data prior to its withdrawal.
- If we conclude a contract with you, we keep your personal data for a longer period than just for the duration of our cooperation until the time of delivery of the goods. For example, for reasons of withdrawal from the contract, complaints, claims for damages and others.
- According to the legal regulations governing accounting, we are obliged to save tax documents for a period of 10 years from the end of the tax period in which the transaction took place. Therefore, we cannot delete your personal data immediately after the goods have been shipped or the complaint period has expired.
- However, we always process your personal data only for the necessary time and to a reasonable extent. The retention period of your specific personal data is then determined according to the following rules:
- for the duration of the contract between us;
- for the time necessary to protect our rights and for the time necessary to determine, exercise or defend legal claims (up to 4 years);
- for the duration of our possible other legitimate interests (up to 4 years);
- for the period specified by law (up to 10 years).

- For the functioning of the website, we use cookies that can record certain specific information from your visits to the website. We can divide cookies into necessary, analytical and marketing cookies.
- The so-called Necessary cookies are needed to ensure the operation of the website. Consent is not required for the use of these cookies, it is our legitimate interest in the website running properly. The use of the so-called analytical cookies is also our legitimate interest. Your rights
- You can ask us to tell you what personal data we process about you, and we must give you access to it if you ask us to do so. Please note, however, that such access does not mean providing all data from our database, but a reasonable communication of what data we process. You can also log in to your user account at any time and change your data in it or delete your account.
- You can ask us to correct incorrect data or complete incomplete data.
- Under certain conditions, we are also obliged to delete your personal data or restrict its processing if you ask us to do so.
- If you suspect that your personal data is being processed illegally, you have the option of filing a complaint with the Office for Personal Data Protection.
- In addition, you also have the right to object if we process your personal data on the basis of our legitimate interest. This objection can be raised by sending it to our contact address or to the e-mail info@winesbay.com . we will evaluate it within one month of receipt at the latest.
